Vexatious Litigants Register

    A register of persons declared vexatious by the Supreme Court of NSW and the orders made against them is now available online.

    Section 84 of the Supreme Court Act 1970 defines a vexatious litigant as someone who habitually and persistently institutes legal proceedings without any reasonable grounds. These proceedings may be commenced against numerous individuals or numerous proceedings might be commenced against a particular individual who is also known as an aggrieved person.

    A person is declared vexatious by an application being made to the Supreme Court of NSW by the Attorney General or the aggrieved person.

    Once a person has been declared vexatious, he or she is unable to continue with proceedings or initiate new proceedings without the leave of the Supreme Court. A vexatious litigant will be given leave to initiate new proceedings if it is found not to be an abuse of the legal process.
