Information Sheet for litigants in person seeking to issue subpoenas

    If you are a party to proceedings but are not represented by a solicitor in the proceedings, then you must seek the leave of the court before a subpoena may be issued at your request. (UCPR 7.3)

    You do this by filing the subpoenas you are seeking to issue, together with written reasons, at the Registry of the Supreme Court on Level 5.

    There are three subpoena forms:
    • Subpoena to attend to give evidence – Form 25
    • Subpoena to produce – Form 26
    • Subpoena to attend to give evidence and to produce – Form 27

    The written reasons should state the reasons for which you are seeking to issue the subpoena(s).

    If you are seeking to issue a subpoena to give evidence, then the written reasons should also state the relevance of the subpoenaed party’s evidence to the proceedings.

    If you are seeking to issue a subpoena to produce, then the written reasons should also state the relevance of the documents you are seeking from the producing party to the proceedings.

    Your application will be considered by the Subpoena Registrar in chambers as soon as practicable, and generally within 24 hours of you filing the above documents.

    You will be contacted once a decision has been made.
