Comments sought: proposed changes to the Practice Note governing copying court documents

    The Court is proposing changes to its current controls over the copying of court documents.

    The current copying arrangements are set out in Practice Note SC Gen 3 - Supreme Court Photocopy access to documents produced under subpoena.

    The draft practice note proposes the following significant changes to existing practices:
    • the new draft note covers the copying of documents on a court file; the existing note excludes these documents
    • under the new draft note, any person entitled to access a document can appoint an approved copying firm to uplift of copy documents;
    under the existing note, only solicitors are permitted to appoint an approved copying firm
    • the new draft note includes a formal Agreement that copying firms must complete and sign when applying to become an approved firm.
    This agreement sets out the obligations of the approved firm towards the Court and defines the Court's rights under the Agreement; the existing note did not include any such Agreement.

    The Court is seeking feedback on these changes, and any other aspects of the draft Practice Note. To help you compare the new draft note against the existing note,
