UPDATE regarding important changes to the Probate Notice

    On 7 June 2013, the Court announced that significant changes would be made to the Online Probate Notice. These changes will still occur, but legal practitioners and their support staff will be given more time to create Online Registry accounts, and prepare by familiarising themselves with the upcoming new features detailed below.

    The Court will publish a further announcement soon containing details of the new implementation date. It will also shortly update the content of its Online Probate Notice webpage to reflect the upcoming changes, including instructions on how self-represented litigants can register quickly and easily once the changes occur.

    You will notice immediately that the appearance of the form has changed (see below). The changes in the form's appearance are designed to draw your attention to specific areas of content, and to clearly separate areas of the form that require data input from any content that is for your information only.

    The content of the opening screen is similar to the existing form, but you will no longer need to indicate the capacity in which you are publishing the Notice (e.g. as a legal representative, assisting a legal representative, representing yourself etc) as the Online Form can now recognise your role using the details you entered when creating your account.

    You will also be given the opportunity to enter your own unique Client Reference Number into the Online Probate Notice in the new "Your reference" field. If you ever need to find the Notice again, you can search your "Filing history" page using this reference and download a pdf file containing the published Notice.



    You might also notice that the content, appearance and behaviour of error messages have changed. In the future, if an error is identified in the online form, a meaningful error message will appear directly beneath the field containing the error.

    Also, if you do not correct the error immediately and you proceed to a different section of the form, the meaningful error message will continue to appear. The error message will also contain a hyperlink that will take you directly to the field containing the error, as illustrated below.

    Although you cannot yet file a summons for a grant of probate, letters of administration or reseal online, the Online Registry can still offer you the ability to independently check how the summons you filed over the counter or by post is progressing through the Court.

    In the future this record will automatically be added to the Case List section of your Online Registry account; this is the page you will see first when you log in.

    When the Court receives any subsequent Summons for a grant of probate, letters of administration or reseal, registry staff will add this application to the same case number associated with the Notice you published online. You can then find the relevant probate case by entering the case number in relevan search field in your Case List.

    Once you find the appropriate case, you can simply click on the hyperlink in the Case Title section and then go to the "Judgments & orders" tab to see if the Court has determined the application, and the orders made. The date the order is recorded in the "Judgments & orders" tab is generally the date upon which the Court has posted the grant to your nominated address for service.
