CHIEF JUSTICE AND COURT OF CRIMINAL APPEAL SITS FOR FIRST TIME IN DUBBO

Date:
02/08/2002

The Chief Justice of NSW, The Hon JJ Spigelman AC and two other senior Supreme Court judges have arrived in Dubbo for an historic sitting of the Court of Criminal Appeal (CCA).

The CCA sitting will take place at the Dubbo court house and will follow the Official Opening of the Court.

“This is the first time that the CCA has sat in Dubbo and only the second time it has sat in rural NSW. As with all CCA appeals the Dubbo appeals will be held in open court. The local community will have the opportunity to observe the administration of justice in cases which involve crimes that have affected their region,” said Chief Justice Spigelman.

Whilst sitting in Dubbo, the CCA will hear four appeals concerning three different prisoners. The first is a Crown appeal concerning Stanley Fernando who was sentenced in March last year for armed robbery. The other hearings are conviction and sentence appeals, brought by prisoners Robert John Grant (sentenced to murder in June last year) and two appeals by RTB. RTB was sentenced in August and December 1999 for sexual assault and indecent assault. NB: There are legal restrictions on identifying RTB by name, as the person was a juvenile at the time of the offences. Identifying the victim is also prohibited.

Joining the Chief Justice on the bench will be The Hon Justice James Wood, Chief Judge at Common Law and The Hon Justice David Kirby.

The official opening and hearing of appeals are open to the public. The official opening will start at 9.30am. The hearing of appeals will start at 10.30am.
