Supreme Court Rules (Amendment No 392) 2004 under the Supreme Court Act 1970 The Supreme Court Rule Committee made the following rules of court under the Supreme Court Act 1970 on 19 July 2004. Steven Jupp Secretary of the Rule Committee Explanatory note The object of these Rules is to amend Part 75 rule 2 of the Supreme Court Rules 1970 (which applies specified provisions of those rules to criminal proceedings in the Supreme Court) as a consequence of the recent substitution of Part 37 (which deals with subpoenas). 1 Name of Rules These Rules are the Supreme Court Rules (Amendment No 392) 2004. 2 Amendment of Supreme Court Rules 1970 The Supreme Court Rules 1970 are amended as set out in Schedule 1. Schedule 1 Amendment (Rule 2) Part 75 Criminal proceedings Omit Part 75 rule 2 (1) (f), (g) and (h). Insert instead: (g) Part 36 (evidence: general) rules 6B, 9, 10, 12, 13BB and 13BC, (h) Part 37 (subpoenas), other than: (i) rules 3 (8), 6 (1) and 7, and (ii) if the issuing party is the Crown, rules 2 (3), 5 and 11, |
