REPEALED Practice Note No.60 - Transfers to the District Court

    PRACTICE NOTE NO 60

    TRANSFERS TO THE DISTRICT COURT

    1 The Practice Note No 7 dated 8 May 1975 is rescinded.

    2 Where, under s 143 of the District Court Act 1973, the Court orders that proceedings in the Court be transferred to the District Court, the party obtaining the order shall, within 10 days after the order is made, lodge with the Registrar a minute of the order for entry with two additional copies.

    3 Where the order is made by the Court of its own motion, the minute of order will be entered by the Registrar.

    4 When the order has been entered, the Registrar will send a certified copy of the minute of order to each party so that the plaintiff or, if the plaintiff defaults, the defendant, may lodge it with a Registrar of the District Court under Part 5 rule 13 of the District Court Rules 1973.
