    PRACTICE NOTE No 91

    Criminal Division - Return of Exhibits


    At the conclusion of proceedings in the Criminal Division, the Court will normally order the return of exhibits whatever the result of the proceedings.

    Part 75 of the Supreme Court Rules 1970 has been amended to allow the registrar to return any exhibits still in the registrar’s custody by forwarding them to the Director of Public Prosecutions after the expiration of 28 days from the conclusion of the proceedings, if there is no undisposed of appeal or application for leave to appeal. The Director of Public Prosecutions would then return any exhibits produced by another person to that person.
