S.65 Guidelines - Electing an Injury

Guideline Pursuant to Section 65.


Clause 6(1) of the Compensation Rule requires an application for statutory compensation to include a description of the compensation injuries for which compensation is sought.

Clause 6(2) requires description of each of those injuries even if the applicant elects under section 11 of the Act to claim a single standard amount or range of compensation for all of those injuries.

The provisions of clause 6 are more honoured in the breach than in the observance.

Even in cases where there is a compliance with clause 6, compensation assessors should have regard to all the evidence in determining whether or not any compensable injury is established. If more than one compensable injury is established the provisions of clause 3 of Schedule 1 will apply.
