Chairperson's Report 1999-2000 4. Victims Compensation Act 1987

As indicated in my last report there were 1,010 claims pending under the Act as at 30 June 1999. All those claims have been determined.

I indicated that with the finalisation of the 1987 Act applications, a review of magisterial staffing would occur. That review has resulted in two magisterial positions being retained, one filled by Magistrate Gabb and the other since March 2000 shared between the Chairperson, Magistrate Brahe and Magistrate Gilmore.

The total amount paid out under the 1987 Act in 1999/2000 was $29.86 million which includes awards, costs and District Court awards and costs. This compares with $46.14 million the previous year.

4.2 Appeals to the District Court.

Under the 1987 Act an aggrieved applicant has a right of appeal to the District Court. Such an appeal is de novo enabling that Court to determine the application. Up to 30 June 2000, 204 appeals had been lodged compared with 500 in the previous year.

The District Court determined 356 appeals as against 648 the previous year. There are 109 appeals pending.

Once more I would like to pay tribute to the Advocacy Section under the leadership of Ms. Hall. Not only does she with Mr. Davis (since resigned) and Mr. McVey represent the Fund in the 1987 Act appeals, but instructs counsel in appeals to the District Court and Supreme Court under 1996 Act. The Section’s involvement has resulted in substantial savings to the Fund.
