Chairperson's Report 1999-2000 7. Year 2000 Amendments to the Act

The amending Bill introduced into Parliament on 31 May 2000 provided that the compensable injury of psychological/psychiatric disorder category 1 is only available where the act of violence arose in the commission of the following offences:
  • armed robbery;
  • abduction; or
  • kidnapping.

That provision commenced in respect of applications lodged on and after 31 May 2000.

The Bill also made provision for a proclamation increasing the threshold from $2,400 and that increase to $7,500 came about on 14 July 2000.

Section 21 was amended to provide for counselling:

(a) to relatives of a primary victim who died as a result of an act of violence but who is not a family victim within the meaning of the Act; and

(b) to primary victims of an act of violence who did not suffer a compensable injury.

Section 30 provides that failure to mitigate must be taken into account in determining a claim for statutory compensation.
