National Competition Policy Review Discussion Paper

Submissions
Submissions on the options and the other matters canvassed in the discussion paper are sought from any person having an interest in the publication of law reports, including consumers, legal practitioners, and publishers.
In addition, submissions are invited to address the following issues:
- What are the restrictive effects of the current system on competition?
- What are the costs and benefits to the community of the restrictions?
- Do the restrictions in the legislation benefit the community to a sufficient extent to outweigh the cost to the community?
- What is the effect of the restriction on the economy generally?
- What issues of market failure does or should the legislation address?
- Are the objectives of the legislation (to establish the Council to select cases, to report speedily, to ensure reports are as cheap as possible, and to ensure efficiency and accuracy) still valid?
- Do these objectives need clarification, or revision?
- Can the objectives of the legislation be achieved only by restricting competition, or are there non-legislative approaches that should be considered?
- Does the legislation in effect breach the competitive conduct rules in Part IV of the Trade Practices Act and the NSW Competition Code?
- What are the effects of recent developments in information technology on the objectives of the legislation?
