    PRACTICE NOTE No 99


    PROBATE DIVISION

    Registrar’s Call-over

    The Registrar in Probate will conduct a call-over, each Friday morning, of proceedings in the Probate Division to which Part 78 Division 3 does not apply. Division 3 applies to proceedings for a grant or for resealing where there is no defendant and no person is cited.

    At the call-over the Registrar may:

          (a) make orders by consent;

          (b) give directions;

          (c) hear and determine any matter within the Registrar’s powers;

          (d) refer to the Probate Judge (to be listed for 10 am that day or on a subsequent Friday) proceedings commenced by summons, and other short matters, that are ready for hearing; and

          (e) stand over, for call-over by the Registrar in Equity, proceedings commenced by statement of claim, and other long matters, that are ready for hearing.
