    Notice to Practitioners

    Interlocutory Matters
    General Equity List


    From 31 May 2010 the practice of referring interlocutory matters to Associate Judges for the fixing of a hearing date will cease. The Registrar in Equity will case manage all interlocutory matters and list them for hearing.

    Interlocutory matters that are to be heard by Associate Judges, will be listed for hearing on Fridays (except when there are FPA running lists). Interlocutory matters that are to be heard by the Registrar will be listed for hearing on each day of the week at 11am. The Registrar will give directions for the filing and service of evidence and the provision of an outline of submissions to the Associate Judge and the Registrar.

    It is essential that counsel and/or solicitors provide an accurate estimate of the time the hearing will take so that the Registrar can list interlocutory matters efficiently. It is also essential that when practitioners provide that estimate they take into account any time needed for an ex-tempore judgment, if reasons are to be required. It is expected that practitioners will only address the real issues in dispute to ensure that there can be a speedy resolution of interlocutory matters before the Registrar and in the Friday Lists before the Associate Judges.
