Progress made in reducing delays in processing probate applications

Date:
03/09/2010

Since the last announcement on 8 February 2010, the Court has made some progress in reducing the lengthy delays in processing probate application.

The current average waiting time on probate applications are as follows:
    • straightforward grants of probate (where there is a will, an executor is applying, and the application is properly prepared): 7-10 working days from date of filing, or receipt of additional information
    • letters of administration (where there is no will) and complex grants of probate (where is an informal will, or the application is not made by an executor named in the will): 8 weeks from date of filing of filing, or receipt of additional information.

By the end of March, straightforward probate grants will be processed within the advertised 5 working day turnaround time, and the waiting time on processing complex applications should be reduced substantially.

The Court will post a new announcement at the end of March containing updated waiting times.
