Probate accounts and commissions

    A review of probate accounts and commissions is currently underway. As part of the review, the Court will be seeking the views of the profession.

    In the interim the following procedures will apply.

    Under s.85(1AA) of the Probate and Administration Act 1898, accounts can be verified and filed or verified, filed and passed, at the discretion of court.

    Where accounts have been filed and no commission is being claimed, the Court will make an order that stands the passing of the accounts over until further order of the court. The Court will pass accounts where no commission is claimed if requested to do so by a beneficiary.

    The Court will continue to pass accounts where commission is being claimed.
