Simplification of the probate application process

        On 1 June 2009, new rules and forms will be available to streamline the probate application process for parties and the Court.

        From June, anyone wanting to apply for a grant of probate, letters of administration or a reseal, will need to prepare UCPR Form 111. This form will replace SCR Form 90.

        Applicants will need to lodge:
        • two copies of UCPR Form 112,
        • if relevant, the original will and codicil/s
        • if relevant, the original grant to be resealed and a copy of that grant
        • the affidavit/s required under SCR Part 78
        • two copies of any supporting documentation required under the revised SCR Part 78, rule 8. These two sets of documents must be stapled together on the left hand side of the page, and accompanied by a stamped, self-addressed A4 envelope.

        An information sheet and checklists have been prepared to help people with their applications.

        If the application is in order and a grant can be made, the Court will post the sealed grant/letters of administration/reseal to the applicant in the stamped self-addressed A4 envelope provided within a reasonable period, but usually within 5 clear working days of receipt.

        If the form of grant requires changes, the Court will return it to the applicant with a probate requisition sheet that sets out the grant's deficiencies.
