Request for comments on the draft Supreme Court Practice Note governing access to court records

Date:
01/18/2010

The Court is seeking feedback on changes it is proposing to make to its Practice Note governing access to court files.

You can download new draft Practice Note by clicking here. If you want to compare the new draft to the existing Practice Note, you can download the current version from this page.

One of the changes proposed in the draft note is that the following fees for access are to apply to access requests, in addition to any photocopying and archive retrieval fees currently payable:
    $95 - standard
    $190 - corporation

As is currently the case with other fees, you will be able to apply to have these fees waived or postponed.

The new draft practice note will also be accompanied by a change to the way transcripts are prepared. Personal identifiers (eg bank account numbers etc) will be redacted and placed in a separate document. Both documents will be provided to the judge and the parties, but only the redacted transcript will be provided to non-parties.

Feedback on these and any other aspects of the practice note, should reach the court by Friday 12 February 2010. The feedback should be addressed to
        Megan Greenwood
        CEO and Principal Registrar
        Supreme Court of NSW
It can be sent in using one of the following means:

        By post:GPO Box 3
        Sydney
        By DX:DX 829, Sydney
        By e-mail:supreme_court@agd.nsw.gov.au
(Please ensure the subject line is "Practice Note consultation: attn. Megan Greenwood")
It is expected the practice note will commence on 1 March 2010 and operate until the Court Information Bill is passed by Parliament and commences operation.
