New case management procedures in defended Possession List matters
Effectively immediately, when a defence or cross-claim is filed in a Possession List matter, the Registrar will set the matter down for an Initial Directions Hearing before a Judge. The Court has introduced this new practice to promote early resolution of defended matters, and to reduce delay in matters at the interlocutory phase of case preparation.
Further guidance about this new practice can be found in the new procedure for defended Possession List matters available on the Practice and Procedure page of the Supreme Court web site.
