Recording and transcribing of proceedings

The purpose of this Direction is to:
    • direct Members of the Tribunal as to hearings in which sound recording is required
    • outline the procedures to be followed to ensure that a full record is obtained.

    OPERATION
        1. This practice note applies from 1 October 2000 to the practice of the Tribunal generally.


    RECORDINGS AND TRANSCRIPTIONS OF TRIBUNAL PROCEEDINGS BY THE TRIBUNAL
        2. In all cases where an amount exceeding $2,000 is claimed in the application, whether the application is made by the Applicant or the Respondent, the Tribunal will sound record all hearings.
        3. Preliminary proceedings, such as case conferences, mediation sessions and directions hearings are not to be recorded.
        4. The conciliation phase of hearings where parties are negotiating alone in the hearing room and a member is not present are not to be recorded.
        5. In large and complex cases the Registrar may, at the request of the presiding member, arrange for the proceedings to be transcribed.
        6. Where a hearing has been recorded, a party may request copies of the recording by applying to the Registrar and paying the prescribed fee.
        7. The Presiding Member in proceedings in the Tribunal retains the discretion to sound record hearings in cases where the claim does not exceed $2,000
        8. If it is not possible to comply with this direction, the Presiding Member is to advise the parties of this situation at the beginning of the hearing, note it in the file and report the matter on the same day to the Registrar.


    RECORDINGS AND TRANSCRIPTIONS OF TRIBUNAL PROCEEDINGS BY OTHER PERSONS
        9. The recording or transcribing by any person of a proceeding before the Tribunal is subject to any directions given by the presiding member.


    GUIDANCE FOR MEMBERS USING SOUND RECORDING EQUIPMENT
        10. A separate circular to assist Members in the operation of sound recording equipment and storage of tapes is available from the Registry.
