A reference made by the Honourable K.M. McCaw, N.L.A., Attorney General, to this Commission, by letter dated 6th September, 1996, includes the review of “the law and procedure in relation to claims in tort for personal injuries”. This references has extremely wide implications which require study in depth of many proposals that have been put forward in Australia and elsewhere. The enclosed working paper deals only with some specific problems, the solution of which does not require any fundamental alteration of the law and procedure generally applicable in claims for personal injuries. Provision in respect of these specific problems need not await the completion of a general review by the Commission. The Commission, in the meantime, is continuing with work on the wider problems raised by the reference.

The tentative proposals expressed in the working paper are those which the Commission presently has under consideration. It will be appreciated that the members of the Commission are as yet uncommitted to these proposals.

No implication may be drawn as to what may be Government policy on any matter.

The paper is circulated to persons and bodies known to be interested. Comment, on matters within the scope of the paper, is invited. It is requested that any such comment be forwarded to the Executive Member, Law Reform Commission, Park House, 187 Macquarie Street, Sydney, 2000, so as to be received by 31st August, 1969.
