As the Table of Contents indicates, this Issues Paper covers a wide range of proposals affecting the law of sale of goods. It discusses the extent to which the law for commercial contracts and consumer contracts should be differentiated. The Commission has also explored the desired scope of the Sale of Goods Act. We discuss whether the Act should extend to
- transactions of lease, hire and hire purchase;
- services as distinct from goods; and
- computer software.
The primary work in the preparation of this Issues Paper has been done by Dr John Carter of the University of Sydney, with the assistance of Mr Kalinga Wijeyewardene, who was then a legal officer of the Commission. The Commission has been most fortunate to have the participation of two members of the Supreme Court of New South Wales: the Honourable Mr Justice Andrew Rogers and the Honourable Mr Justice J R T Wood, who have contributed from their extensive knowledge and experience in relation to commercial law.
