What's New
- To address the lack of uniformity in the regulation of surrogacy arrangements in Australia, the Standing Committee of Attorneys-General (SCAG) and Ministerial Councils for Community Services and Health have released a paper proposing a national model for the regulation of surrogacy.
The paper was released to further inform the public discussion of this complex and sensitive area of the law. A national model will not be finalised until there has been thorough community consultation. Submissions closed 16 April 2009.

- Review of the Dust Diseases Claims Resolution Process – Issues Paper December 2008
The Dust Diseases Claims Resolution Process (CRP) was established after the Review of Legal and Administrative Costs in Dust Diseases Compensation Claims conducted in 2004-2005. The CRP was reviewed in 2006, after data on its first 12 months of operation became available (the 2006 Review). The 2006 Review recommended a number of minor changes to the Regulation establishing the CRP. The recommended changes commenced operation in March 2007.
The 2006 Review recommended that consideration be given to a further review of the CRP, but preferably only where there had been sufficient experience using the CRP (perhaps in July 2008). As the CRP has been in operation for three years, it has been decided to conduct that further review now.
The Current Review is to consider the overall operation of the CRP, and in particular:
- the impact of the CRP on legal, administrative and other costs; and
- whether further reforms should be implemented to reduce legal, administrative and other costs.

- The Standing Committee of Attorneys General is working on a project to design a national model Bill for a spent-convictions scheme. A spent-convictions scheme provides for certain criminal convictions to be disregarded, for most purposes, after a sufficient period of good behaviour. A consultation paper and bill are available for download. Submissions closed 27 January 2009.
- Trees Statutory Review Commenced: submissions closed 18th February 2009. More information is available for download, Trees Statutory Review- |PDF, 23kb | DOC, 52kb|
- The Attorney General's Department has conducted a statutory review of the Crimes (Appeal and Review) Act 2001 to examine whether the Act remains appropriate for securing its objectives. The Act provides a legislative framework for appeal and review rights from the decisions of courts exercising summary jurisdiction. Public consultation was undertaken during the course of the review. The attached Report concludes that the Act is largely effective in achieving its objectives and contains 17 recommendations to improve its operation.
- Jury Selection - Law Reform Commission Report 117
The Law Reform Commission's Report 117 Jury selection was released for public consultation. The Commission makes 74 recommendations concerning jury selection, and other jury-related issues, including:
- developing new criteria for selecting and disqualifying jurors, and the grounds upon which potential jurors may apply to be excused from service,
- improving jurors’ pay, conditions, facilities and amenities,
- improving protections for jurors’ employment, and
- reviewing penalties for failure to attend jury service.

The NSW Attorney General’s Department invited interested individuals and organisations to make written submissions to the review. The closing date for submissions was 21 March 2008.
