New case management procedures for Class 5 criminal matters
The Criminal Procedure Amendment (Summary Proceedings Case Management) Act 2012 was passed by Parliament on 13 March 2012 and received assent on 21 March 2012. It is scheduled to commence operation on Monday 30 April 2012.
The object of the Act is to amend the Criminal Procedure Act 1986 to make provision for case management procedures to reduce delays in trial and sentencing proceedings before the Supreme Court and the Land and Environment Court in their summary jurisdiction. Amongst the measures the courts may make are orders requiring that certain disclosures be made by the prosecution and the defence before a trial or sentencing hearing.
The Land and Environment Court will shortly release a Practice Note for Class 5 matters to reflect the provisions of the Act.
The Hon. David Henry Lloyd QC has been appointed as an Acting Judge of the Court for the period commencing on 5 March 2012 until 4 May 2012.

New Commissioner of the LEC (8 December 2011)
NSW Attorney General, Greg Smith SC, today announced the appointment of Ms Susan O'Neill as a Commissioner of the Land and Environment Court of NSW. Ms O'Neill commences on Monday 30th of January 2012. Read the press release.
The Judges, Commissioners and staff of the Court note, with sincere regret, that the esteemed former Chief Judge of the Land and Environment Court (1992-2003), the Hon. Mahla Liane Pearlman AO, passed away early this morning after a long and courageous battle with illness.
Her funeral is scheduled to be held at 10.30am on Sunday 4 December 2011 at the Sydney Chevra Kadisha, 172 Oxford Street (cnr Oxford & Wallis Streets), Woollahra.
Ms Pearlman was held in extremely high regard, both personally and professionally, by all who dealt with her during her distinguished service as the Court’s Chief Judge, and in all other offices she held.
On 25 November 2011 it was my pleasure to make a presentation to Ms Pearlman in recognition of her contribution to the field of Environmental and Planning Law. As she was unable to attend, Justice Terry Sheahan accepted on her behalf and said, inter alia:
"Mahla is a woman of great charm, dry wit, deep loyalty, and supreme ability, but has never lost her unassuming down-to-earth Boggabri manner, nor her love of the bush – Boggabri to Bendooley to Gresford.
She’s a great “lady of the land” in every way.
She led the Court supremely well, and did all the “Chief Judge cases” of her time. She brought to them her fine legal mind and her beautiful writing style.
She richly deserves this recognition, but is “seriously chuffed” by it, and pleased to be joined in it with Ben Boer and Rob Fowler."

Law vacation 2011-12:
The Judges' fixed vacation begins on 16 December 2011 and the first day of term in 2012 will be 30 January 2012.
Matters may be listed for s 34 conferences, mediations and hearings before Commissioners throughout the fixed vacation except for the public holidays of 26 and 27 December 2011, 2 and 26 January 2012.
The final Registrar directions hearing list for 2011 will be Thursday 22 December 2011.
The Registrar's directions hearing list will resume on Monday 9 January 2012.
A Duty Judge will be available during the vacation for urgent matters. (17 October 2011)

The Hon. Michael Francis Moore has been appointed as an Acting Judge of the Court for the period commencing on 3 October 2011 until 16 December 2011. (21 September 2011)
Mr Anthony Logan McAvoy has been appointed as an Acting Commissioner of the Court from 21 September 2011. Mr McAvoy has expertise in Aboriginal land rights. (21 September 2011)
The Chief Judge has approved a new Tree Dispute Application form (Form C), which replaces version 2 of the same form. The new form takes effect from 19 September 2011.
Commissioner Graham Brown has been appointed as the Acting Senior Commissioner of the Court from 25 August 2011 to 24 February 2012.

On July 12, the Minister for Planning announced that a review would be undertaken of the planning laws of NSW. He announced that the review would be co-chaired by Senior Commissioner Moore (who has taken leave from the Court commencing on 22 July) and former Labor Minister Ron Dyer. (22 July 2011)

Registry Announcement: The Land and Environment Court registry refurbishment is now complete and the registry has returned to level 4. Operating hours for the registry continue to be 8:30am-4:30pm. (5 July 2011)
