S.65 Guidelines - Interpretation of Section 32
Guideline pursuant to section 65.
Section 32(1) of the Act makes provision for the payment of an award of statutory compensation to the applicant or to any other person for the benefit of that person.
Subsection (2) provides that in making a decision as to whom an award of statutory compensation should be made payable, the compensation assessor must have regard to the likelihood that a person by whom an act of violence was allegedly committed may receive the benefit of the award or any part of the award.
In my view section 32(2) is no warrant to refuse to make an award of statutory compensation.
Section 30 provides reasons for not making an award or for reducing the amount of compensable payable whereas section 32 provides to whom compensation may be made payable.
