The Professional Standards Council of NSW was established in 1995 under section 39 of the Professional Standards Act 1994 (NSW). The legislation was introduced with bipartisan government support and was the first in the world with its goal of balancing consumer protection by raising professional standards and limiting liability.

The Professional Standards Council of NSW was constituted in 1995 with 12 members nominated by the Attorney General of NSW. The current Council is comprised of members nominated by each state and territory Attorney General, as well as one nominee by the Commonwealth Assistant Treasurer.
