This Privacy Code of Practice was approved by the Attorney General on 28th June 2000 and Gazetted in Part 2 of the Government Gazette of 30 June 2000 at page 60004.

Privacy Code of Practice
This is a code of practice made in accordance with Part 3 Division 1 of the Privacy and Personal Information Protection Act 1998.
1. Coverage
This code is intended to cover the Legal Aid Commission only, and only in relation to the collection of personal information relating to financially associated persons and dependants.
2. Interpretation
In this code:
“Commission” means the Legal Aid Commission of New South Wales.
“dependant” means any person who is financially dependant on the applicant for legal aid, whether or not they reside with the applicant.
“financially associated person” means any person from whom an applicant for legal aid usually receives financial support or who would be likely to financially assist the applicant in obtaining legal services.
“section” means a section of the Privacy and Personal Information Protection Act.
3. The code
Section 8
There is no intention to depart form the requirements of section 8.
Section 9
Compliance with section 9 is not required to the extent that personal information relating to a financially associated person or dependant is collected from an applicant for legal aid for the purpose of determining that applicant’s eligibility for legal aid under the Commission’s means test.
Section 10
Compliance with section 10 is not required to the extent that personal information relating to a financially associated person or dependant is collected from an applicant for legal aid for the purpose of determining that applicant’s eligibility.
Section 11
There is no intention to depart form the requirements of section 11.
Section 12
There is no intention to depart form the requirements of section 12.
Section 13
There is no intention to depart form the requirements of section 13.
Section 14
There is no intention to depart form the requirements of section 14.
Section 15
There is no intention to depart form the requirements of section 15.
Section 16
