Changes in terminology and calculation of total sentence
Under (NSW) Sentencing Act 1989 s.5 sentences were divided into minimum terms (the minimum period the offender served in custody) and additional terms (the remaining portion of the sentence in which the offender was eligible for release to parole.) When calculating the total sentence from the sentencing table the minimum term and the additional term must be added together. Where a fixed term was set the offender was required to serve the entire period in custody, with no eligibility for parole.
Under the Crimes (Sentencing Procedure) Act 1999 the court is now required to set the total term of the sentence, and the non-parole period (the minimum period the offender must serve in custody). When calculating the total sentence do not add together the two figures in the sentencing table. The total sentence is the first figure appearing in the column.
