Jury Service: Payments
If you are not being paid a normal wage during your jury service you are entitled to receive a jury attendance fee. A statutory declaration is required before any jurors can receive a jury fee. A copy may be down-loaded from here or will be provided to you at the court.
For those jurors eligible, payment is made on a scale dependent on your employment status.
The scale increases after day 10 of the trial. The payment scale for jurors who are not being paid wages during jury service is shown below:
Jurors who are not being paid wages are paid in accordance with the following:
- for less than 4 hours attendance and not selected on the first day: NIL
- for more than 4 hours on the first day: $102.50
- for the 2nd to 10th day: $102.50
and after day 10 the scale used depends on your employment status
- 11th day and subsequent days for Jurors not Employed: $102.50
- 11th day and subsequent days for Jurors who are Employed: $230.60
Payment can be deposited into your bank account by electronic funds transfer and the funds are in your account generally within 2 days.Cheque payments can be made available but often take up to 10 days or longer to arrive.
To receive the jury attendance fee, you must fill out a Statutory Declaration that you can get at the court complex. This will state that you are employed, not employed or that your employer will continue to pay your normal wage while on jury service. Generally, the form will be handed to you during the selection process or can be down-loaded from this page.
All jurors who attend and are not excused are entitled to a travel allowance. The rate is based on the distance between the courthouse and your suburb (that appears on your summons). The allowance covers a return journey at the rate of 30.70 cents per kilometre. The minimum payment is $4.30 each way and the maximum payment for travel is 100 kilometre a value of $30.70 each way.
If your jury service requires you to be present over lunch a meal is provided for you. If a meal cannot be provided an allowance of $6.75 will be paid to you.
Note: Jury attendance fees may be subject to income tax. We recommend that you obtain independent taxation advice.
