Cost orders

With regard to settlement of costs orders in matters funded from the core legal fund, the following requirements apply:

  • Where the core legal fund is liable to pay substantial costs (in excess of $50,000), a letter must be sent to the Director General of the Attorney General’s Department, from the Crown Solicitor’s Office, notifying the Director General of the costs order. Approval must be sought from the Director General for any settlement of the claim.

  • Where the core fund is to benefit from a costs order, a letter must be sent to the Director General from the Crown Solicitor’s Office notifying him or her of the order. Approval must be sought from the Director General for any settlement of the costs claim where the amount foregone will exceed $50,000.
