  • Statistics on the Operation of the Dust Diseases Claims Resolution Process 2006-2007
    In 2006, the Government initiated a review of the Dust Diseases Claims Resolution Process (CRP).

    As part of that review, the Government released an Issues Paper which contained an overview of the first full 12 months of operation of the CRP in respect of claims which were commenced between 1 July 2005 and 30 June 2006. Data was also provided in respect of transitional claims which commenced before 1 July 2005.

    The report on the review was released in January 2007. The report recommended that data in relation to the operation of the CRP be published every 12 months.

    In accordance with that recommendation, a paper has been prepared containing data in relation to the second full 12 months during which the CRP operated (that is, between 1 July 2006 and 30 June 2007). A copy of the paper can be obtained by clicking here.

  • Crimes (Appeal and Review) Act 2001
    The NSW Attorney General is reviewing the Crimes (Appeal and Review) Act 2001.
    The aim of the review is to determine whether the policy objectives of the Act remain valid and whether the terms of the Act remain appropriate for securing those objectives.
    The Crimes (Appeal and Review) Act 2001 provides a legislative framework for appeal and review against the decisions of courts exercising summary criminal jurisdiction. The Act applies to Local Courts as well as the Children’s Court, a Warden’s Court and a Licensing Court.
    The NSW Attorney General’s Department invites interested individuals and organisations to make written submissions to the review.
    Submissions should be sent to the Director, Legislation and Policy, NSW Attorney General’s Department, GPO Box 6, Sydney NSW 2001 or emailed to: lpd_submissions@agd.nsw.gov.au. The closing date for submissions is 1 June 2007.

  • Review of the dust diseases claims resolution process
    The Government initiated a review in August 2006 of the Claims Resolution Process for dust diseases claims. A Report outlining the review's conclusions was published in January 2007. While no major changes were proposed for the Claims Resolution Process, a number of recommendations were made for minor amendments to improve its operation.
    As the Dust Diseases Tribunal Regulation 2001was due for Staged Repeal on 1 September 2007, the Government also released for public comment the proposed Dust Diseases Tribunal Regulation 2007 and a Regulatory Impact Statement, in compliance with the Subordinate Legislation Act 1989.
    The final Dust Diseases Tribunal Regulation 2001 was made on 28 February 2007 and was published in the Gazette on 2 March 2007.
  • Litigation Funding Discussion Paper (PDF document) (Word document) - In November 2005, the Standing Committee of Attorneys General (SCAG) agreed that further consultation and research should be undertaken into regulating the litigation funding industry. This paper sets out the legal context of litigation funding, and some issues upon which comment is invited. Results of the consultation will be considered by SCAG, and together with forthcoming High Court decisions on the topic, will inform the decisions of Ministers in the development of any regulatory proposal. Comments are now being sought on the paper. Submissions can be made on a pro forma Word document should people wish to use it to respond. Submissions close on 14 September 2006
  • The Attorney General is reviewing the policy relating to access to court information and documents. The purpose of the review is to articulate the policy in respect to access to court documents and information and to make proposals for change that promote greater certainty in relation to rights of access and a more consistent application of that policy. The review attempts to state in more definitive terms the rights of individuals to obtain access to court information having regard to the principle of open justice and privacy. Stakeholders are invited to provide submissions to the Legislation and Policy Division Attorney General's Department GPO Box 6 Sydney or by email to lpd_enquiries@agd.nsw.gov.au by 14 July 2006

  • The report of the NSW Legal Fees Review Panel on legal costs in NSW (pdf document).
    The Government is considering this report and invites submissions from interested stakeholders.

  • EXPOSURE DRAFT CIVIL LIABILITY AMENDMENT BILL 2006

    The Government invites submissions on the Exposure Draft of the Civil Liability Amendment Bill 2006. The Bill proposes to permit the recovery of damages by a claimant in a negligence action for the claimant’s loss of capacity to provide gratuitous domestic services to the claimant’s dependants. These damages, also known as Sullivan v Gordon damages, were previously allowed in NSW, however, a recent High Court decision has meant they can no longer be awarded.
