2009-2010 Law Vacation Update

The Judges’ fixed vacation begins on 21 December 2009 and the first day of term in 2010 will be 1 February 2010. This means that the last sitting day will be Friday 18 December 2009.

Matters may be listed for s 34 conferences and hearings before Commissioners throughout the fixed vacation except for 25, 26 and 27 December 2009, 1 and 26 January 2010.

The final Registrar directions hearing list for 2009 will be on 18 December 2009 and the directions hearing list will resume on 18 January 2010.

A Duty Judge will be available during the vacation for urgent matters.

5 May 2009	On 1 May 2009 the Chief Judge issued a new court attire policy. The policy applies also to proceedings in Class 8 of the Court's jurisdiction.

7 April 2009	From today, the Court has commenced its jurisdiction over Mining matters. The Court has established a practice collection for the mining jurisdiction, which can be accessed through the "Mining Jurisdiction" link on the homepage.
3 April 2009	On 1 April 2009 NSW Attorney General John Hatzistergos announced the appointment of Ms Rachel Pepper as a Judge of the Land and Environment Court of NSW. The press release can be found here.
27 March 2009	From 7 April 2009, the Land and Environment Court will have jurisdiction to hear and dispose of proceedings under the Mining Act 1992 and the Petroleum (Onshore) Act 1991. The Court will be establishing a separate practice collection to assist parties, including self represented litigants, by providing a wide range of information about the Court’s new mining jurisdictions.
19 March 2009	A Paper on "Practice and Procedure" by Justice Peter Biscoe for a visiting delegation of the Thai Judiciary.
12 March 2009	The judgment in Double Bay Marina Pty Ltd v Woollahra Municipal Council [2009] NSWLEC 1001 at [47]-[52] which proposed a planning principle, concerning discerning the public interest in development applications, has not been adopted by the Court and will not be published on the Court's website as a planning principle of the Court.
11 March 2009	The Chief Judge has made a new instrument of delegation of powers in functions to the Registrars under s 13 of the Civil Procedure Act 2005, effective 11 March 2009.
