In Yang v Scerri [2007] NSWLEC 592, Brown C, Hoffman C and Fakes AC set out an appropriate “rule of thumb” for the term “in the near future” in s 10(2)(a) of the Act in order to provide some consistency in the application of this requirement. They said:
14. Ordinarily, the near future would involve a time period extending from the date of determination of the application to 12 months.
In Dooley & anor v Nevell [2007] NSWLEC 715, Moore C and Thyer AC considered the questions of jurisdiction and causation for the purposes of the four tests in s 10(2) of the Act in the context of a claim concerning termite damage. They held that the Court had no jurisdiction in such matters because: “… the fact that a tree may attract and provide habitat, whether temporary or permanent, to an animal, bird or insect does not mean that any damage caused by such an animal, bird or insect is, in any way, caused by the tree which provides that habitat.” | Moore C |

The Judges' fixed vacation begins on 17 December 2007 and the first day of term in 2008 will be 29 January.
Matters may be listed for s 34 Conferences and Hearings before Commissioners throughout the fixed vacation except for 25, 26 and 27 December 2007, 1 and 28 January 2008.
The final Registrar Directions Hearings for 2007 will be on 21 December and the 2008 Directions Hearings will commence on 15 January.

| 22 August 2007 | Land and Environment Court arrangements during APEC 2007 Conference (Sydney)
The APEC Economic Leaders Meeting will be held in Sydney commencing on Sunday, 2 September 2007 through to Sunday, 9 September 2007.
The Land and Environment Court will be operating as normal during the period Monday, 3 September 2007 to Thursday, 6 September 2007. Friday, 7 September 2007 is a Public Holiday in metropolitan Sydney and the Court will be closed for business.
Practitioners or clients attending the Land and Environment Court in Sydney in the above period are advised to allow extra travelling time given the potential for delays due to road changes and increased security.
