Practice Direction: Vacation of hearing dates

Ref: Practice Direction 1993 – paragraph 4 (effective 1 November 1993)

(a) Application to vacate hearing dates may be made to the Registrar by motion up to 14 days prior to the hearing. The party filing the motion for vacation should supply material supporting the grounds for the adjournment and advise whether the application is consented to by the other party or parties.

(b) Where the application is made less than 14 days prior to the hearing date, the application must be made by way of motion with affidavit evidence in support of the motion. The motion will be heard by a Judge.
