Practice Direction: Short service

Ref: Practice Direction 1998 – paragraph 2 (effective 1 February 1998)

Any application for leave for short service of process shall be by motion made in accordance with Part 9 of the Rules of the Court except that the motion may be made without prior filing or service of a notice of motion.
The motion must be supported by an affidavit stating the following:


(i) The grounds for the relief claimed;

(ii) the reasons for non-compliance with the requirements for service prescribed by the Rules of the Court;

(iii) when service of the process is proposed to be effected;

(iv) whether the person to be served has been consulted concerning the motion, and if so, whether he or she consents to the proposed short service.
