Mining Jurisdictions


From 7 April 2009, the Land and Environment Court has jurisdiction to hear and dispose of proceedings under the Mining Act1992 and the Petroleum (Onshore) Act1991.

This is the Land and Environment Court's practice collection. Through this web page the Court provides links, to assist parties, including self represented litigants, to a wide range of information about the Court’s mining jurisdictions. Additional material will be added as it becomes available.

  • All mining matters on or after 7 April 2009 are to be commenced in the Land and Environment Court and will be heard and determined by the Land and Environment Court.
  • All criminal proceedings under those Acts are allocated to the existing Class 5 of the Land and Environment Court’s jurisdiction (Land and Environment Court Act1979: s 21)
