Court Attire Policy

Purpose

This policy aims to ensure barristers appear before the court in attire that meets the Court’s expectations.

Application

This policy applies to:

  • Barristers appearing in certain types of proceedings in selected classes of the Court’s jurisdiction heard by a Judge.
  • Barristers appearing in Class 8 of the Court's jurisdiction heard by a Commissioner for Mining.
  • Barristers attending ceremonial sittings of the Land and Environment Court.

Proceedings in which robes are to be worn

Barristers are expected to wear robes but not wigs in the following types of proceedings heard by a Judge:
  • All proceedings in Class 4, Class 5, Class 6, Class 7 and Class 8.
  • The following proceedings in Class 3:
      o objections to the determination of boundaries;

      o encroachment of buildings; and

      o claims for compensation by reason of the acquisition of land.
Barristers are expected to wear robes but not wigs in proceedings in Class 8 heard by a Commissioner for Mining.

However, robing is not required before the List Judge or at directions hearings, callovers, mentions and motions relating to procedural matters.

Ceremonial sittings

Barristers are expected to wear robes but not wigs for all ceremonial sittings of the Land and Environment Court.
