Class 8 Urgent injunction applications – how they will be dealt with
Parties seeking an urgent injunction pursuant to s 295 of the Mining Act 1992 should contact the Land and Environment Court registry on 9113 8200 (after hours, a message on this number will provide a contact number for the Registrar).
An application for an urgent ex parte injunction can be listed before a Commissioner for Mining or a Duty Judge on short notice. It may be dealt with in chambers, over the phone or in court. Arrangements should be made with the court registry on the above number.
Fees payable for filing process for an urgent injunction will be dealt with either by a credit card authority received by facsimile in the registry (before the application is dealt with), or by the Commissioner or Judge accepting an undertaking from a solicitor to pay the fee.
