Announcement - Certificates under the Legal Profession Act 1987

This announcement clarifies the previous announcement of 10th September 2002.

Certificates under section 198L of the Legal Profession Act 1987 are dealt with in the Registry as follows:

Unfair Dismissal - section 84

  • Certificates are mandatory for applications filed by a legal practitioner
  • Certificates are mandatory for replies filed by a legal practitioner

Unfair Contract - section 106
  • Certificates are mandatory for applications filed by a legal practitioner
  • Certificates are mandatory for replies filed by a legal practitioner

Victimisation - Section 213
  • Certificates are mandatory for applications filed by a legal practitioner where such application asserts an entitlement to the payment of monetary compensation for damages suffered by the applicant

Debt Recovery
  • Certificates are not required for debt recovery matters.

Generally:
  • If there is no certificate a written undertaking to supply one within 7 days is acceptable
  • A fax of an undertaking is acceptable
  • Litigants in Person are not required to file a certificate.
