INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES
PRACTICE DIRECTION NO. 7
Pursuant to Rule 89 of the Industrial Relations Commission Rules 1996
SYDNEY OLYMPIC ARRANGEMENTS
1. The purposes of this Practice Direction are to:
(a) make provision for special arrangements for sittings of the Industrial Relations Commission of New South Wales during the Olympics period (11 September to 2 October 2000); and
(b) advise the industrial community, the legal profession and other interested persons of those arrangements.
2. This Practice Direction will become effective 14 days after publication in the Industrial Gazette.
3. The following arrangements will apply to the Sydney locations (50 Phillip Street and Xerox House, 815-825 George Street) of the Industrial Relations Commission of New South Wales, and also at the Newcastle (237 Wharf Road) and Wollongong (90 Crown Street) locations, during the period 11 September 2000 to 2 October 2000 inclusive:
(1) The Registry offices at 50 Phillip Street Sydney and Wharf Road Newcastle will remain open on normal business days during the period 9am to 4pm with minimum staffing levels. Staff will deal as a priority with the processing of urgent matters and otherwise will process other matters which are filed in the Commission although non urgent matters will not be listed during this period.
(2) The Commission’s location at Xerox House will not be open. Members hearing Sydney matters who would normally sit at Xerox House will sit at 50 Phillip Street. Details of matters listed should continue to be available in the Law Notices and on the internet.
(3) A number of Members will be rostered to deal with urgent disputes and other urgent applications which may arise during this period.
(4) Notification of urgent disputes or other urgent matters should be made in the normal way including notification by facsimile transmission and, if necessary, telephone. Where application by notice of motion and affidavit is appropriate, such documents may be filed by facsimile on facsimile number (02) 9258 0058. Any dispute notification which is required to be processed outside normal business hours may be made by telephoning (02) 9258 0012.
(5) Any notification or other application which is sought to be listed during the Olympics period shall set out the reasons why the matter should be so listed, and where relevant, particulars of those reasons.
(6) Urgent dispute matters which need to be dealt with during this period and which would normally be heard at 50 Phillip Street Sydney may be dealt with at alternative court locations if access to 50 Phillip Street Sydney becomes difficult. Such locations may include the Commission’s premises at Wharf Road, Newcastle and Crown Street, Wollongong.
(7) Matters which the Commission would normally deal with such as award applications, section 84 proceedings, occupational health & safety prosecutions, section 106 applications etc. will not be listed for hearing during this period other than in exceptional circumstances.
(8) The Commission’s Courts at Newcastle and Wollongong will, subject to paragraph (5), function in the usual way during this period.
(9) It is expected that normal sittings will resume at Xerox House on Tuesday, 3 October 2000.
