It is uncommon for plaintiffs or defendants to appear in person before the Tribunal or to represent themselves in the Claims Resolution Process mediations.
The reason for that is the complex nature of dust diseases litigation.
A dust disease is one of gradual onset. It may be years before a person is aware of any deterioration in health. During these years he/she may have changed jobs several times and may be faced with the problem of establishing:
- which employment caused the dust disease ?
- which employer is liable to pay any damages ?
- whether the employer is still in business ? and
- whether the employer was insured during the relevant employment period?
