What information does the Tribunal require on the first Directions Hearing ?

Cases are usually listed for directions before the President of the Tribunal each Monday.

Practitioners appearing before the Tribunal are expected to be familiar with their case and be able to inform the Tribunal about the following:

  • Nature of the disease alleged.
  • Conditions and prognosis of the Plaintiff’s health.
  • Current state of the pleadings.
  • Readiness for hearing and whether:

      (a) experts' reports have been obtained and served;

      (b) further medical examinations are required and if so, when;

      (c) technical or financial experts have been, or are to be qualified to prepare reports.

  • Whether admissions have been sought and have, or will have, been made.
  • Whether orders for discovery and interrogatories have been made or will be sought.
  • Whether particulars have been filed and served.
  • The nature of orders, if any, made earlier and if they have been complied with.
  • Completion date for the timetable.
  • Proposed date for hearing.
