What is the Dust Diseases Tribunal of New South Wales?
The Dust Diseases Tribunal of NSW was established as a court of record by the Dust Diseases Tribunal Act 1989. It deals with personal injury compensation claims in negligence for diseases resulting from exposure to asbestos and other dusts.
Function
The main function of the Tribunal is to determine dust diseases claims but it can also determine ancillary or related matters such as,
nervous shock,
Compensation to Relatives Act claims
product liability,
contribution or indemnity between tortfeasors, and
indemnity arising under policies of insurance.
Legislation
Many pieces of legislation apply to the Tribunal including, the Dust Diseases Tribunal Regulation 2007, the Dust Diseases Tribunal Rules, the Supreme Court Rules 1970, the Civil Procedure Act 2005 and the Uniform Civil Procedure Rules 2005.
