Becoming a Justice of the Peace
Application forms are only available from the electorate office of State Members of Parliament (MP). For contact details of your nearest MP visit www.parliament.nsw.gov.au.
Documents you must submit with your application form
When you lodge your application you need to bring proof of Australian Citizenship in the form of
- Australian Passport OR
- a certified copy of your citizenship certificate OR
- a certified copy of your Australian birth certificate
If your name differs from your current name, you must also bring:
- a certified copy of your change of name document such as deed poll, marriage certificate
AND
- proof of use of your current name such as a current driver's licence, Medicare card or current seniors card.
To be eligible for appointment as a Justice of the Peace in NSW, you must:
- be at least 18 years of age
- be nominated by a member of the Legislative Assembly or the Legislative Council (MP or MLC)
- be an Australian citizen or a person who is entitled to vote at a general election, unless the Attorney General exempts the person from having to satisfy this criterion
- be of good character
- consent in writing to confidential inquiries being made as to the person’s suitability for appointment, including a criminal records check
- not be an undischarged bankrupt
- establish that your appointment as a justice of the peace is required for your employment or to fulfil a community-based need for the appointment
The Application Process
You must lodge your completed application with your State MP. If endorsed, the MP will forward the application to the Community Relations Unit for processing. The following process takes place in respect of a new application:
- application is checked for completeness (complete applications are entered on the JP database and incomplete ones returned to the applicant)
- acknowledgement is sent to applicant and nominator MP
- criminal record check is requested from the NSW Police Force
- application is progressed subject to suitability (following police check)
- applicant is included in a schedule of appointment for the Minister’s recommendation
- schedule of appointment is forwarded to the Governor for approval
Following approval by the Governor:
- you will be sent notification of your appointment with a form to complete your oaths of office at a Local Court
Please allow 6 to 8 weeks for notification of appointment to be sent to you.
- you will be asked to return the completed oath form to the Community Relations Unit so that your appointment can be confirmed
- your oath form will be processed and you will be issued with a confirmation of appointment letter showing your appointment details, your new JP registration number and a Justice of the Peace Handbook
- you must read the information in the JP Handbook before beginning to perform Justice of the Peace duties.
