Exemptions to Anti-Discrimination Act
Under the Anti-Discrimination Act 1977 (the Act) it is generally against the law to discriminate against or harass people on the basis of their race or sex (including pregnancy and sexual harassment), disability, age, marital status, transgender status or carer’s responsibilities.
This applies in the areas of employment, provision of goods and services, state education, club membership and rental accommodation (except for carer’s responsibility which only applies in the area of employment).
However, there are some exceptions in the Act where it is legal to target jobs or services to favour one particular group where it is an essential requirement of the job or where a particular race or age group has special needs.
In addition, section 126A of the Act gives the Attorney General the power to certify special needs programs and activities so they do not breach the provisions of the Act.
