Torts Law (Justice/Law Enforcement Agencies)

The Torts Law (Justice/Law Enforcement Agencies) Practice Group provides expert advice in tortious matters involving State Justice and law enforcement agencies. The Team has a longstanding history of representing the interests of the State of New South Wales and law enforcement agencies.

The Team is experienced in representing law enforcement agencies in both litigated and unlitigated matters, and provides legal analysis, alternative options, assessment of risks, and a recommended course of action including consideration of interlocutory applications, ADR, and appeals. The Team has acted in a number of matters in the District Court, the Supreme Court, the Court of Appeal and the High Court which have provided precedents in areas of law in which the team practises.

The Team is familiar with undertaking complex claims requiring diligent investigation and the expertise to extract relevant information from extensive documentation and provide succinct summaries encapsulating crucial evidence, which are then used to advise and defend the claim. The Team has an unparalleled wealth of knowledge and has accumulated documents and resources over years of conducting litigation on behalf of law enforcement agencies. The Team has a comprehensive knowledge base on issues that arise when a claim is made against a client, and will recognise and advise the client on emerging and evolving areas of civil liability affecting law enforcement agencies.

Members of the Team act on behalf of a number of clients in both the criminal and civil jurisdictions and in relation to production of documents in response to subpoenas, and appear in courts throughout New South Wales. The Team provides advice regarding objections that may be taken to the production of documents on either statutory or common law grounds.
