Constitutional and Native Title Law

The Constitutional and Native Title Practice Group deals with matters affecting the (Commonwealth) Constitution and native title and Aboriginal land rights claims. The team features highly skilled, specialised solicitors who work on matters which can have significant social impact for the State of NSW and its people. The solicitors are assisted by 2 highly experienced research officers/historians, a paralegal and secretarial and administrative support staff. The practice group also assists the Solicitor Generals' Special Committee.

Solicitors specialising in Constitutional Law advise the NSW Attorney General who is given notice of every question arising under the Commonwealth Constitution for determination in a court, whether intervention is warranted. If it is, submissions on behalf of the State will be made either by Counsel or a solicitor in the group. Solicitors also advise on conflicts that may arise between Federal and State law as well as drafting and advising on international and intergovernmental agreements.

Work regarding native title and Aboriginal land rights matters primarily includes:

  • Representing the Crown Lands Minister in land claims made under the Aboriginal Land Rights Act 1983 (NSW);
  • Representing the State Minister in native title claims under the Native Title Act 1993 (Cth);
  • Arranging for historical and tenure research to be carried out on land under claim; and
  • Advising on issues relating to native title.

The matters handled by the Constitutional and Native Title Practice Group include
  • Aboriginal Land Rights: land claims;
  • Native Title;
  • Commonwealth Constitutional Law;
  • Special Committee of Solicitors General;
  • Intergovernmental Agreements; and
  • International Agreements, Treaties and Conventions.
