The Commercial/Property (Litigation) Practice Group conducts litigation and provides related advice on all aspects of commercial law, property law and revenue law. The group also offers the services of a solicitor advocate who advises and appears for clients in all jurisdictions, offering clients a cost-effective advocacy service.

The litigation and advisory services offered by the team include:

• providing advice and representation for the Chief Commissioner of State Revenue on a large range of issues, including appeals to the Administrative Decisions Tribunal and the Supreme Court against objection determinations of the Chief Commissioner, in relation to such areas as stamp duty, land tax and payroll tax;
• undertaking litigation involving property related matters, particularly in the Land and Environment Court concerning land valuations;
• providing advice on commercial litigation practice and procedure and statutory interpretation of legislation relating to revenue law, corporations law and trusts;
• providing advice and representation in litigation arising from contractual disputes;
• undertaking winding up and bankruptcy proceedings and providing advice and assistance in respect of insolvency work generally;
• providing advice and representation for Government agencies involved in disputes as to ownership of intellectual property and engaging in copyright litigation to stop unlawful infringement of State copyright;
• handling trade practices, tender and building disputes and providing related advice;
• managing large debt recovery work for a range of Government agencies;
• leasing, licensing and landlord and tenant disputes;
• handling disputes relating to caveats, easements and covenants;
• providing representation in relation to a range of insurance law and privatisation litigation; and
• representing the State of NSW before Royal Commissions and Inquiries concerning commercial and property law issues.
