The Child Protection Practice Group specialises in particular areas of law dealing with child care, protection and welfare issues. The matters handled by the Practice Group include:
Care and Protection
The Child Protection team acts in care proceedings in the Children's Court under the Children and Young Persons (Care and Protection) Act 1998,appeals to the District Court from orders of the Children's Court, applications to the Supreme Court under its parens patriae jurisdiction, including for urgent medical treatment, applications to the Supreme Court for prerogative relief, adoptions, Family Law Act proceedings in the Family Court, Federal Magistrates Court and the Local Court, applications to the Administrative Decisions Tribunal for review of administrative decisions in relation to foster carers and placement of children in foster care, and advices concerning the care and protection of children.
Succession Law and related matters
The Child Protection team provides advice and representation in matters concerning wills, estate entitlements and trusts and family provision claims on behalf of children under the parental responsibility of the Minister of Community Services.
