Administrative Law
The Administrative Law Practice Group specialises in the areas of statutory interpretation, administrative law, Freedom of Information (FOI) and privacy. The group regularly appears for CSO clients before the Supreme Court and the Administrative Decisions Tribunal in applications to review administrative decisions and in FOI and privacy matters. The practice group's solicitors have had carriage of numerous high profile and politically sensitive matters in courts and tribunals and have acted for Government clients in special commissions of inquiry.
The practice group's Assistant Crown Solicitor has instructed counsel in significant matters such as challenges to the Government's proposed alterations to local government boundaries. Senior solicitors have also acted for Government clients in Special Commissions of Inquiry including the Glenbrook and Waterfall rail accidents.
Matters handled include:
- advice on a range of legislation giving powers to Government bodies, agencies and officers;
- representation and advice in Freedom of Information and privacy matters;
- advice and representation in matters involving procedural fairness and other administrative law grounds of review; and
- matters involving advising or making application to the Supreme Court to have a person declared vexatious with the result they require leave before commencing any further proceedings.
The Administrative Law Practice Group also runs educational seminars for clients, publishes updates on Administrative Law issues and conducts client training.
